The following excerpt is from Anderson v. Superior Court, 11 Cal.4th 1152, 48 Cal.Rptr.2d 766, 907 P.2d 1312 (Cal. 1995):

The final case that the majority relies on in drawing its distinction between duties assignable to elective and appointive officers, Kelly v. Kane [11 Cal.4th 1169] 1939) 34 Cal.App.2d 588, 94 P.2d 384, is not relevant. In that case, duties were transferred from one appointive office to another appointive office. (Id. at pp. 589, 591, 94 P.2d 384.) Because there was no transfer of duties from an elected officer, no question arose in that case as to the electorate's right to vote or the restrictions on transferring duties from an elected officer.
