The circumstances of the transfer distinguish this case from the Fenelon Case (Fenelon v. Yanch), 262 N.Y. 57, 308, 186 N.E. 201, 794, in that the signature card which was signed by decedent specifically and lucidly stated that it created a joint account with right of survivorship.
