4 Apparently applying Proposition 64, the court stated that the conspiracy charged in Count 1 would now be a conspiracy to commit a misdemeanor, but that the conspiracy would remain a felony. (See People v. Tatman (1993) 20 Cal.App.4th 1, 7, 24 Cal.Rptr.2d 480 (Tatman ) ["A conspiracy to commit a misdemeanor may be punishable as a felony"].) The court also reduced Counts 2 and 3 to misdemeanors.
