5. Because this case was not final at the time of the Sanchez decision, we follow the "basic postulate of appellate review" that the current state of the law applies on appeal, rather than the law at the time of trial. (People v. Charles (1967) 66 Cal.2d 330, 335.) Hence, the law established in Sanchez applies to this case.
