What is the current state of the doctrine of strict liability in medical equipment cases?

California, United States of America

The following excerpt is from Grinnell v. Charles Pfizer & Co., 274 Cal.App.2d 424, 79 Cal.Rptr. 369 (Cal. App. 1969):

3 In Greeno v. Clark Equipment Company (N.D.Ind.1965) 237 F.Supp. 427, 429, the court noted that the doctrine of strict liability is 'hardly more than what exists under implied warranty when stripped of the contract doctrines of privity, disclaimer, requirements of notice of defect, and limitation through inconsistencies with express warranties.'
