The following excerpt is from People v. Lovelady, A129765, A129834 (Cal. App. 2012):
By pleading guilty to the simple possession count, defendant prevented the jury from determining whether she possessed methamphetamine solely for sale or for another purpose as well. She cannot raise the issue for the first time on appeal. (See, e.g., People v. Pinon (1979) 96 Cal.App.3d 904, 909-910 ["There is, however, a more fundamental reason why these issues may not be raised on appeal: since they go to the question of guilt or innocence, they have been 'removed from consideration' by the guilty plea"].) Her lesser included offense argument was forfeited by her plea.1
