What is the case law in which a conviction for possession of cocaine base for sale is overturned?

The parties state, and we agree, that the conviction on count 3, active street gang participation, should be reversed in light of People v. Rodriguez (2012) 55 Cal.4th 1125 (Rodriguez). The parties also agree that the abstract of judgment contains a clerical error. Finally, they agree that an amendment to the sentencing triad for possession of cocaine base for salefrom three, four, or five years to two, three, or four yearsrequires resentencing on that count.
