Accordingly, this matter is adjourned for a hearing, the parties to be notified of the date. The court expresses no opinion concerning the merits of this case, but will point out that the law requires the petitioner, as a non-parent third party, to meet a heavy burden in order to obtain the relief requested. See Bennett v. Jeffries, 40 N.Y.2d 543, 387 N.Y.S.2d 821, 356 N.Y.S.2d 277.
