What is sufficient evidence to convict a drug dealer of a drug trafficking charge?

MultiRegion, United States of America

The following excerpt is from U.S. v. Leon-Gutierrez, 931 F.2d 898 (9th Cir. 1991):

Sufficient evidence to support a conviction exists if, "a reasonable jury, after viewing the evidence in the light most favorable to the government, could have found the defendants guilty beyond a reasonable doubt of each essential element of the crime charged." United States v. Hernandez, 876 F.2d 774, 777 (9th Cir.), cert. denied, 110 S.Ct. 179 (1989) (citation omitted); Jackson v. Virginia, 443 U.S. 307, 319 (1979). To convict under 18 U.S.C. Sec. 924(c), the government must prove that the defendant carried a firearm and that he did so during and in relation to the charged drug trafficking offense. United States v. Power, 881 F.2d 733, 735 (9th Cir.1989). The defendant need not display or use the firearm. Id., 881 F.2d at 737.
