Considering the facts of the instant case with particular reference to the presence or absence of the significant jurisdictional elements mentioned above and to the statutory presumption that the claim comes within the provisions of the statute (Workmen's Compensation Law, 21; Post v. Burger & Gohike, supra), we conclude that the board's exercise of jurisdiction should be upheld.
