The following excerpt is from People v. Montgomery, 132 Cal.Rptr. 558, 61 Cal.App.3d 718 (Cal. App. 1976):
'1,12] It is not material, upon this appeal, as to the particular ground upon which the court based its order granting the new trial; for if the order should have been made upon any one of the grounds raised by defendant, it will be affirmed.' (People v. Castro, supra, 133 Cal. 11 at p. 12, 65 P. 13 at p. 14.) In this case the second ground on which the court acted is one of the grounds raised by defendant.
