What are the causes of action against the trustees of a trustee's trust?

California, United States of America

The following excerpt is from Bryan v. Bank of America, 103 Cal.Rptr.2d 148, 86 Cal.App.4th 185 (Cal. App. 2001):

1The trial was after remand after we issued an opinion (Bryan v. Meleyco AO73403, filed on Oct. 14, 1997), reversing an order sustaining a demurrer to the complaint, and vacating the judgment against appellant. The complaint alleged that the trustees of appellant's trust tortiously evicted her from her residence and unjustifiably had her placed in a community care facility. The causes of action alleged were breach of fiduciary duty, intentional infliction of emotional distress, false imprisonment, fraud, professional negligence, invasion of privacy, conspiracy, and, as to two defendants, wrongful eviction. Our earlier opinion concluded that, although appellant's first amended complaint was poorly drafted and organized, it was an abuse of discretion to dismiss it without leave to amend.
