For example, in People v. Hughes (2002) 27 Cal.4th 287, the defendant was charged with murder, burglary, robbery, and forcible sodomy. (Id. at p. 315.) There was evidence that, at the time of the alleged crimes, he was under the influence of cocaine and alcohol. (Id. at pp. 315, 321.) There was expert testimony that "the combination of drugs and alcohol ingested by defendant likely caused 'significant impairment' of defendant's mental abilities at the time of the charged crimes."
