There is a more general problem: do the individual plaintiffs have a cause of action separate from West One’s cause of action, in view of the rule in Foss v. Harbottle (1843), 67 E.R. 189? I do not think lumping everyone together as “the Plaintiffs” avoids or provides an answer to this problem.
