The court’s decision in Vollick v. Sheard is being released contemporaneously with the release of the decision in the present case. The factual basis in Vollick is indistinguishable in principle from that in the present case. For the reasons given in Vollick, Marcus is not a “protected defendant” within the meaning of the Insurance Act.
