Vagueness is not to be confused with the notion of overbreadth, which deals with the question whether legislation is drafted so widely that it catches more conduct than is constitutionally permissible: Committee for the Commonwealth of Canada v. Canada (1991), 1991 CanLII 119 (SCC), 77 D.L.R. (4th) 385 at pp. 432-4, [1991] 1 S.C.R. 139, 4 C.R.R. (2d) 60, per L’Heureux-Dubé J. The issue of overbreadth will be considered later in the discussion of the issue of proportionality.
