I agree with the defendant that the term “under cultivation” should be given a broad and liberal interpretation however I do not agree with the defendant that that approach is contrary to the decision of Cofrin v. Bicchieri. In my view the above noted definitions are consistent with the view that under cultivation means a present actual state of being cultivated.
