In Toronto Transit Commission v. ATU, Local 113 [2012] O.L.A.A. No. 328the grievor was discharged for failing to stop his street car in time to avoid striking the rear of a van. The arbitrator ordered that he be reinstated but not in an operator’s position. Relying on that decision the Union suggests Mr. Perrin be reinstated in another position at ETS for which he is qualified that does not involve him driving a bus.
