Third, the courts have recognized that, where a crosswalk is unmarked, a pedestrian is entitled to some margin of error with respect to the specific confines of the crosswalk. As noted by plaintiff’s counsel, liability should not turn on a tape measure where an unmarked crosswalk is involved. In Taggart v. Heuchert, 2013 BCSC 1248 at paras. 139–140, the court stated:
