The test for admission of third party suspect evidence is straightforward and not in dispute. Evidence of the potential involvement of a third party in the commission of an offence is admissible provided it meets the test of relevancy and has sufficient probative value to justify its reception: R v. Grandinetti, 2005 SCC 5 (CanLII) (“Grandinetti”).
