A third party notice must set out a concise statement of the material facts giving rise to the claim (SCCR 3-5(11) referencing SCCR 3-1(2)). A material fact is one that when resolved will have legal consequences as between the parties to the dispute; Sahyoun v. Ho, 2013 BCSC 1143, at para. 26.
