What date should the petitioner's shares be valued as of the date it receives audited financial statements, accounting and disclosure?

British Columbia, Canada

The following excerpt is from Melcer Estate, 2018 BCSC 775 (CanLII):

With respect to the valuation date, the petitioner submits that the shares should be valued as of the date it receives the audited financial statements, accounting, and disclosure. The valuation date should be the date that the valuator conducts the valuation: see e.g. Livramento v. Millennium Powder Coating Ltd., 2007 BCSC 1282 at para. 58.
