[23] The trial justice held, (correctly in my respectful view), that the qualifications of the officer are not an essential element of the offence: See R v. Xu, 2012 ONCJ 278. Notwithstanding the deficiencies in the officer’s testimony, the trial justice clearly accepted that the officer was qualified because her experience in using the particular device.
