In Clark v. Zigrossi, [2010] O.J. No. 4266, D.M. Brown J. explored the tension between a judge deciding a threshold motion either before or after the jury’s verdict. At para. 9 he stated: In light of the differing rules of judge and jury, the timing of the hearing of a threshold motion during a jury trial, takes on some significance. If the motion is heard and decided before the jury renders its verdict, then, one might argue, the jury has laboured for not. On the other hand, if the motion is heard and decided after the jury renders its verdict, might the judge be unduly influenced by the verdict?
