The leading highest authority on the issue of mobility is Gordon v. Goertz, 1996 CanLII 191 (SCC), [1996] 2 S.C.R. 27. Both parties filed case books which included several other cases on the issue of mobility, including several Ontario Court of Appeal cases. All of these cases provided the court with direction and insight into this issue. Ultimately, as both counsel conceded, the result of this trial comes down to how I determine the facts from the evidence and apply the legal principles to those facts. Threshold Test
