The following excerpt is from Linklater v. McLaughlin Motor Car Company Ltd., 1923 CanLII 137 (SK CA):

In the Quirk v. Thomas Case, the plaintiff brought an action for breach of promise. The defendant died after action was commenced and the executor continued the defence. The jury found in favour of the plaintiff that the deceased had promised to marry her, and gave her £350 damages. The verdict being set aside on the ground that the action could not be maintained, no costs were allowed to her.
