The proposed third parties submit that it is not just and convenient to grant leave to file the third party notice in circumstances where it is unnecessary and bound to fail. They cite Shvalian v. Seafresh Products Distributors, Inc., 2014 BCSC 964 at para. 24: …the expense and trouble of duplicated proceedings must consider the cost to a third party particularly when liability by the defendant is denied and is genuinely and actively defended.
