The test for the granting of an injunctive relief is set out in RJR-MacDonald v. Canada (Attorney General), 1994 CanLII 117 (SCC), [1994] S.C.J. No. 17 (S.C.C.) as follows: a) Is there a serious issue to be tried? b) Will the applicant suffer irreparable harm if the injunction is refused? c) Which of the parties is likely to suffer greater harm from the granting or refusal of the injunction pending a decision on the merits?
