As to the test for a "rational connection" the learned trial judge referred, at para.194, to R.J.R.-MacDonald Inc. v. Canada (A.G.), 1995 CanLII 64 (SCC), [1995] 3 S.C.R. 199 and at para.206 to Lavigne v. OPSEU, 1991 CanLII 68 (SCC), [1991] 2 S.C.R. 211. Applying the law stated in those cases he concluded that the impugned legislation did have a rational connection to its objective. In this, and without endorsing his supporting reasons, I cannot say that he erred.
