The following excerpt is from Hum v. The Royal Canadian Mounted Police, 1986 CanLII 6484 (CHRT):

The present state of law is, then, that the police do not have an unlimited right to ask citizens to identify themselves, let alone answer questions on their citizenship and place of birth. Their power is limited to the authority which is provided by statute or derived from the common law. The decision in Moore v. The Queen illustrates a circumstance in which the statutory authority was found to flow from the Criminal Code, in particular section 450.
