The appellant submits that the applicable standard of review on questions of law is correctness. For questions of fact, the standard is palpable and overriding error. A palpable and overriding error is defined as “clear to the mind or plain to see”: see Housen v. Nikolaisen, 2002 SCC 33 (CanLII), [2002] S.C.R. 235, at paras. 5, 8, 10, 26.
