The judge noted that the standard of care for drivers in those circumstances is not one of perfection, citing para. 69 of Hadden v. Lynch, 2008 BCSC 295. In Johns, the defendant admitted that he should not have braked, but that admission was insufficient for the trial judge to find that the defendant failed to meet the standard of care.
