If a stallion falls into a well before January 16, 1925, is the stallion entitled to sue?

Saskatchewan, Canada

The following excerpt is from Dille v. Great West Life Assurance Co., 1926 CanLII 109 (SK CA):

The question therefore remains, whether the stallion was killed by falling into the well in question before or on or after January 16, 1925. If it was killed before that date, the case comes within the decision in Haworth v. Webb, supra, and the plaintiff is entitled to succeed. If the accident happened after that date, the plaintiff has no right of action.
