Considering the state of the information received by the adjuster as of that date, and on reviewing the authorities cited by counsel for the defendants as to the courts' range for damages for that relevant period of time, 1981, I cannot conclude that the settlement was unconscionable or unfair. There is nothing to cause me to conclude that the transaction diverges so greatly from current standards of commercial morality that it should be rescinded (Smyth v. Szep).
