The latter point was in doubt at one time owing to the following comment made by Mr. Justice Rinfret in Rogers v. Davis, 1932 CanLII 10 (SCC), [1932] S.C.R. 546 at 547: I know of no law or rule - and none was cited to me - which compels persons to appear by the same solicitor because their interest, as regards their opposition to the claim of the plaintiff, may be identical.
