The appropriate standard of review with respect to a decision by a statutory tribunal depends upon a number of factors, such as whether there is a privitive clause, the nature of that clause, the expertise of the tribunal involved, the purpose of the Act and the particular provisions being scrutinized, and whether the matter considered by the tribunal is a question of fact or law. (Pushpanathan v. Canada (1998) 1998 CanLII 778 (SCC), 160 D.L.R. (4th) 193 (S.C.C.)).
