Is there a duty on a straight through driver to take extra care when approaching a left turner at a busy intersection?

British Columbia, Canada

The following excerpt is from Wilson v. Reid, 2020 BCCRT 835 (CanLII):

23. The presence of a vehicle waiting to turn left does not cast a duty on the straight through driver to take extra care, and the straight through driver is entitled to presume the left turner will not start a turn until the straight through driver has cleared the intersection (see: Krist v. Bock, 2018 BCSC 433).

24. Additionally, the onus is on the left turning driver to prove that they started to turn left when it was safe to do so (see: Nerval v. Khera, 2012 BCCA 436 at paragraph 33).
