In addition, I pause here to note that the meaning of a right to pass and repass was recently considered by Chiasson J.A., dissenting, in Robb v. Walker, 2015 BCCA 117 at para. 56: The right to pass and repass clearly is a right of access, but it does not authorize using the servient land. For example, it does not authorize stopping for a picnic or to pick berries.
