46 Clearly, some harm can be permissible in order to ensure protection of the freedom of expression (and even harm which is arguably significant): see for example R. v. Keegstra 1990 CanLII 24 (SCC), [1990] 3 S.C.R. 697 and Ross v. New Brunswick School District No. 15 (1996) 1996 CanLII 237 (SCC), 1 S.C.R. 825.
