The courts have recognized that the right of a client to have a lawyer’s account assessed is an important right and that ordinarily lawyers should consent to an assessment (Borden Ladner Gervais LLP v. Cohen 2005 CanLII 21114 (ON SCDC), 2005 199 O.A.C. 9).
