The respondents apply for reconsideration of the severance decision on the basis of an alleged change of circumstances. They seek an order setting aside the July 10, 2007 severance order, and for an order that the justification defences concerning the 1999 logging events be deferred awaiting the aboriginal title issues which they propose be heard first. They say that the justification issues can be determined later, if necessary, after the title issue in this case is determined, and the outcome of the appeal of Tsilhqot'in Nation v. British Columbia, 2007 BCSC 1700 is known.
