The Respondent submits that, in the context of this litigation, the concern of personal privacy must give way to the proper administration of justice and fairness. The Respondent submits that she would be severely hampered in the conduct of her case if the clinical records were not provided. The Respondent relies upon Regina v. Snider, 1954 CanLII 40 (SCC), [1954] SCR 479 at 482, for the proposition that “the public has a right to every man’s evidence”.
