The applicant’s belief that he was singled out due to his age is not evidence but a mere assumption. See Sosoo v. Winners Merchants Incorporated and Workers United Ontario Council, 2010 HRTO 1367, para. 71. On a balance of probabilities I cannot find that the applicant’s age was a factor in the respondent’s treatment of him in the Park during the incident.
