[17] The respondent acknowledges that this was not his first impaired driving charge. He was charged in the late 1980’s, to the best of his recollection. The charge was stayed as a result of the decision in The Queen v. Askov, [1990] 2 S.C.R. 1199, 113 N.R. 241, 75 O.R. (2d) 673, 42 O.A.C. 81, 74 D.L.R. (4th) 355, 49 C.R.R. 1, 59 C.C.C. (3d) 449, 79 C.R. (3d) 273, 1990 CanLII 45, [1990] S.C.J. No. 106, 1990 Cars­well­Ont 111. The respondent’s licence was reinstated in May 2001.
