In assessing the relative degrees of fault, a number of factors may be considered. These factors were summarized by Groves J. in Aberdeen v. Langley (Township), 2007 BCSC 993. This summary has been consistently relied as a synopsis of the general legal principles to apply in determining relative degrees of fault for the purpose of apportioning liability. The defendants did not take issue with this analysis.
