39 In Quadrini v. Canada Revenue Agency and Hillier, 2009 PSLRB 104 (CanLII), in the context of a case where the PSLRB determined that it had authority to determine the validity of a claim for solicitor-client privilege, it relied on the doctrine of necessary implication. The employer had argued that the PSLRB had no power either to order the production of documents subject to solicitor-client privilege or to determine the validity of a claim for privilege.
