In Byrd v. Cariboo Regional District, although Madam Justice Bruce denied the application to add the Province as a defendant, she rejected the Province’s argument that it would suffer actual prejudice because it would be unable to locate the approving officer or serve a third party notice on the party against whom the claim had long since been discontinued. With regard to the former, she indicated that even if the Province had been made a party when the action commenced, the same issue would likely still have existed.
