The plaintiff cites Durant v. Lennard for the proposition that the test to be applied is not a subjective one. Rather the proper standard is objective: whether a reasonable person would expect icy conditions would have been present.
In Cranfield v. McKay, the defendant driver, after encountering ice, lost control of her vehicle. In finding for the plaintiff, Sigurdson J. said this:
