The following excerpt is from Coburn v. Nagra and Lomax, 2001 BCSC 234 (CanLII):

"Proof", for the purposes of the law, is a matter of persuasion, not demonstration or replication at will. And for the purposes of the law, once the trier of fact is persuaded that something in the past was thus and so on a balance of probabilities, a certainty has been arrived at. (Athey v. Leonati S.C.C. October 31, 1996, para. 28.)
