Not every communication between a lawyer and a client is privileged. The communication must be for the purpose of seeking or giving legal advice and must be intended by the parties to be confidential: McClure, at para. 36. However, given the importance of the privilege, any uncertainty as to the application of the privilege should be resolved in favour of protecting confidentiality: Descoteaux v.
